Terms and Conditions of Sale (T&Cs)

Preamble

These terms and conditions of sale (hereinafter "T&Cs") govern the sale of products offered on the website uselockin.fr by Mohamed El Kourachi (hereinafter "the Seller"), a micro-enterprise registered under SIRET number 10190963800013, whose registered office is located at 20 Boulevard Alexandre de Fraissinette, Saint Étienne.

Any order placed on the website implies the Buyer's full and unreserved acceptance of these T&Cs.

Article 1 — Products

The products offered for sale are described on the website as accurately as possible. Product photographs are not contractually binding. In the event of an error or omission, the Seller cannot be held liable.

Article 2 — Price

Prices are shown in euros, all taxes included. As the Seller falls under the VAT-exemption scheme for small businesses (Article 293 B of the French General Tax Code), VAT is not applicable. Shipping costs are included in the displayed price, unless stated otherwise.

The Seller reserves the right to modify prices at any time, it being understood that the price applicable to an order is the one in effect at the time the order is confirmed.

Article 3 — Order

The Buyer places an order by adding products to the cart, then confirming the cart and proceeding to payment. Any confirmed order constitutes acceptance of the price and product descriptions.

Article 4 — Payment

Payment is made online by credit card (Visa, Mastercard, American Express) via Shopify Payments, or by PayPal. Payment is secured by SSL encryption.

The order is deemed effective once payment has been confirmed by the banking institution.

Article 5 — Delivery

Products are delivered to the address provided by the Buyer when placing the order.

Delivery areas: mainland France, Belgium, Luxembourg, Switzerland.

Estimated delivery times:

  • Mainland France: 2 to 4 business days
  • Belgium, Luxembourg: 3 to 5 business days
  • Switzerland: 4 to 7 business days

Shipping is free and included in the displayed price.

In the event of a delivery delay exceeding 30 days from the order date, the Buyer may request cancellation of the sale and obtain a full refund in accordance with Article L.216-2 of the French Consumer Code.

Article 6 — Right of withdrawal

Withdrawal period and returns In accordance with Article L.221‑18 of the French Consumer Code, the Buyer has a period of 14 days from receipt of the product to exercise their right of withdrawal without justification.

Acceptance of returns The Seller accepts returns of both defective and non-defective products within the 14-day period.

Exchanges Exchanges are accepted subject to product availability.

Return method and costs Returns and exchanges may be made in store or via a drop-off point indicated by the Seller. Except in the case of a defective product, return costs are borne by the Buyer. No restocking fee will be applied.

Condition of returned products The product must be returned in its original condition, unused or barely used, with all its accessories and packaging.

Refund The refund is issued within 14 days of receiving the returned product, using the same payment method used for the order.

To exercise the right of withdrawal, the Buyer must notify their decision at contact@uselockin.fr before the period expires.

Article 7 — Legal warranty

All products are covered by the legal warranty of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). In the event of non-conformity, the Buyer may request the repair or replacement of the product.

The Lock-IN product also comes with a commercial warranty of 2 years from the date of purchase.

Article 8 — Liability

The Seller cannot be held liable for non-performance of the contract due to force majeure, an unforeseeable event, or the act of a third party.

Article 9 — Personal data

The information collected when placing an order is necessary for its processing and is subject to the Privacy Policy available on the website.

Article 10 — Disputes and applicable law

These T&Cs are governed by French law. In the event of a dispute, the Buyer is informed that they may resort to conventional mediation or to the European online dispute resolution platform: https://ec.europa.eu/consumers/odr

Failing that, the competent court shall be that of the defendant's place of residence.
